Free bilingual rental agreement for Indonesian car and scooter rentals: SIM and IDP, STNK, SNI helmets, Jasa Raharja, ETLE fines, UU PDP. Word and PDF.
Indonesia has more small motorbike and car rental shops than almost anywhere in the region, and most of them run on a one-page agreement in one language. That works until something goes wrong: an ETLE camera ticket arrives after the renter has flown home, a scooter comes back without its STNK, or a renter's travel insurer refuses a claim because the rider had no valid licence.
This version of our free agreement is written for those situations. Choose Indonesia in the form, add your details, and download it as Word or PDF.
Language. Law 24/2009, article 31 says agreements involving an Indonesian party must be in Indonesian, and when a foreign party is involved they can also be written in English. Presidential Regulation 63/2019 lets the parties choose which version governs. The agreement puts both languages side by side, clause by clause, and says the Indonesian text prevails.
Licences and IDP. Under the Road Traffic Law 22/2009, every driver needs a licence for the vehicle class and must carry it with the STNK. In Indonesia that means SIM A for cars and SIM C, CI or CII for motorbikes, depending on engine size. Police Regulation 2/2023 recognises foreign permits issued under an international convention or agreement. Whether Indonesia has ratified the 1968 Vienna Convention is not clearly confirmed, so the clause asks for a foreign licence plus an IDP covering the class (A for motorbikes, B for cars), and lets you refuse handover without them. A car licence never covers a motorbike.
Helmets. Rider and passenger must wear SNI-standard helmets, and the rider is liable for a passenger without one (hukumonline). The agreement has you supply two SNI helmets and allows one passenger.
Compulsory insurance. The yearly vehicle tax includes the SWDKLLJ contribution to Jasa Raharja. It pays fixed benefits to accident victims (for example up to IDR 50 million for death), not vehicle damage, and it usually excludes a driver who caused the accident. If your own cover is Total Loss Only, a separate clause explains that TLO pays only for theft or very heavy damage (typically 75% of the vehicle's value).
Passports and ID. The Immigration Law 6/2011 requires foreigners to show their passport or stay permit when an officer asks, so the agreement says you won't keep an original passport, KTP, KITAS or driving licence. You take a photo or copy instead.
Personal data. The Personal Data Protection Law 27/2022 has applied in full since October 2024. The data clause limits what you collect to the rental, fines, claims and records, and tells the renter they can ask to see, correct or delete it.
Traffic fines. ETLE camera notices go to the registered owner, who must confirm the driver or pay within 8 days, or the registration can be blocked. The agreement lets you name the renter as the driver, keep part of the deposit for up to 30 days, and recover any fine you had to pay.
Unfair terms. Consumer Protection Law 8/1999, article 18 voids standard clauses that shift your liability onto the consumer or refuse all refunds. The cancellation and damage clauses are written to stay on the right side of it.
