Free English–Malay car and motorcycle rental agreement for Malaysian operators: APAD licensing, JPJ summonses, child seats, PDPA, no MyKad deposits.
Car rental in Malaysia is more regulated than in most of the region. Hire-and-drive cars need an operator licence, and the authorities have said so publicly: in 2023 APAD's director-general warned that renting out private cars without a licence is illegal, may breach the insurance and can lead JPJ to seize the vehicle. The same report noted that police treated some unreturned rental cars as a breach of contract rather than theft. That is exactly the situation where your written agreement becomes the main evidence you have.
Our free agreement for Malaysia is built for small car and motorcycle rental businesses, in English with a full Malay translation. Malaysia is preset in the form.
Operator licensing. The owner confirms that the vehicle is registered with JPJ, its road tax is valid, it is insured for rental use, and that you hold the right operator licence: APAD in Peninsular Malaysia for "kereta sewa dan pandu", LPKP in Sabah and Sarawak under the Commercial Vehicles Licensing Board Act, or MOTAC for tourism hire-and-drive cars under the Tourism Vehicles Licensing Act 1999.
Licences and IDP. Drivers need class D or DA for cars and B, B1 or B2 for motorcycles, or the foreign equivalent. Under RTA section 28, foreign licences count only where a treaty recognises them. JPJ says IDPs are valid for one year. We couldn't confirm on an official page exactly how long a visitor may drive on a foreign licence, so the clause refers to "the period JPJ allows" and asks for an IDP or official translation where required. Check with JPJ if your customers stay long.
Helmets and pillion. The Motor Vehicles (Safety Helmets) Rules require helmets for rider and pillion, and RTA section 49 allows one pillion, sitting astride.
Child seats. Child restraint systems have been compulsory in private cars since 2020, with a fine of up to RM300. JPJ's FAQ sets the criteria. The agreement asks renters to request a child seat when booking.
Compulsory insurance. The Road Transport Act section 91 requires cover for death or bodily injury to others. It does not require property damage cover and never covers the rented vehicle. The insurance section explains this in plain words and links it to your excess.
Passports and MyKad. Possessing another person's passport without lawful authority is an offence under the Passports Act 1966, and the National Registration Department says holding someone else's MyKad is against the law. The agreement takes a cash or card deposit and a photo instead.
Personal data. The PDPA 2010, as amended in 2024, now uses "data controller" and brings mandatory breach notification and data portability from June 2025. The data clause covers purpose, retention, breach notice and access requests.
Summonses. Summonses come from PDRM, JPJ (including AES/AwAS cameras) and local councils, checkable on MyBayar PDRM and MyJPJ. Under RTA section 53B, a registered owner who wasn't driving must name the driver within 30 days. The agreement lets you do that and hold part of the deposit for up to 30 days.
Accidents. Section 52 requires a police report within 24 hours. The accident clause repeats it and asks for a copy.
Fair fees. After the Federal Court's Cubic Electronics decision, a named sum for breach is recoverable only as reasonable compensation up to that sum. The Consumer Protection Act's unfair terms rules also apply. So the agreement keeps late, cleaning and admin fees moderate and says they are genuine estimates.
