Free English–Khmer rental agreement for Cambodian motorbike and car shops: Prakas 0067 Khmer contracts, 125cc licence rule, helmets, Siem Reap.
Rental shops in Phnom Penh, Siem Reap, Kampot and Sihanoukville mostly rent scooters to tourists and expats, priced in US dollars, often against a passport left at the counter. That habit is the first thing to change: the UK and US governments both tell travellers not to hand over a passport for a motorbike rental. The second is the language of the contract.
Cambodia's Law on Consumer Protection (2019) and Prakas 0067 on Unfair Contract Terms (2022) require standard-form consumer contracts to be prepared in Khmer. A rental agreement you hand every customer is exactly that kind of contract. Article 5 of the Constitution also makes Khmer the official language. So our agreement puts English and Khmer side by side, and the Khmer text prevails if they differ.
This page is in English only, but the agreement you download is bilingual. Cambodia is preset in the form.
Licences. The Australian government's advice is that a car or a motorbike over 125cc needs a Cambodian licence, or a foreign licence plus an IDP, carried together, and that bikes up to 125cc can be ridden without a licence under Cambodian law. Cambodia is party to the 1949 Geneva Convention. The clause requires whatever licence the law requires, and warns that insurance may not apply to an unlicensed rider, even on a small bike.
Helmets. The Road Traffic Law in force since 2016 requires every rider and passenger, including children, to wear a helmet, and police issue on-the-spot fines. The agreement limits the bike to one passenger and makes helmets fastened at all times.
Insurance. The 2014 Law on Insurance makes third-party liability insurance compulsory for certain business vehicles, but the regulator said in March 2026 that implementation remains uneven. The agreement says the vehicle carries whatever insurance the law requires, explains that third-party cover never pays for the rented vehicle, and links damage to your excess and price list.
Fair terms. Prakas 0067 treats clauses that exclude or limit the business's liability, or allow one-sided changes or arbitrary termination, as unfair. The Civil Code also voids advance exclusions of liability for intentional or grossly negligent breach, while allowing pre-agreed damages. Our cancellation, damage and termination clauses are written with that in mind.
Siem Reap and local rules. Siem Reap's provincial authorities have long banned renting motorbikes and cars to foreign tourists in town: the governor restated the ban in 2017, saying it dated from 2002, and a 2024 report said tourists may rent only bicycles or e-bikes. A 2026 article describes it as "previously implemented", so current enforcement is unclear. Check with the provincial authorities before renting motorbikes to tourists in Siem Reap. The agreement has a clause where you confirm you may lawfully rent at the place of rental and the renter agrees to follow local rules.
Passports. The agreement says you won't keep the original passport or ID card, and you take a photo instead. Our deposit guide suggests cash deposits that work in place of a passport.
Personal data. As of mid-2025, Cambodia's personal data protection law was still a draft. The data clause applies good practice anyway.
Traffic fines. Camera speeding fines are paid at a payment centre within 30 days and can reach you after the renter has left. The agreement lets you hold part of the deposit for up to 30 days and pass fines to the renter where the law allows.
Accidents. The Road Traffic Law lets parties settle property-only accidents between themselves. That makes it more important that the renter doesn't agree a private settlement without you, which the accident clause requires. Emergency numbers: police 117, ambulance 119.
Borders. The vehicle must not leave Cambodia. Crossing into Thailand, Laos or Vietnam needs permits, customs papers and separate cross-border insurance.
Cambodia is preset. Add your shop, vehicle, rates, deposit and permitted area, leave anything blank to write in, and download Word or PDF. Other countries are on the main free rental agreement page. This is general information from public sources, not legal advice.
RoveHQ fills in the agreement from each booking automatically, the renter signs on their phone, and passport and licence details are read from a photo, so you never need to keep the passport. Start free.
